Welcome to Stillglow ("Company", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of our website and photo animation services (collectively, the "Service") located at stillglow.org.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Description

Stillglow is a photo animation service that transforms your still photos into beautiful, gentle motion videos. Our Service allows you to:

• Upload photos to be animated using AI technology
• Choose from different animation styles and moods
• Create single photo animations or story mode with multiple photos
• Download and share your animated memories
• Purchase credits to create more animations

3. Content Storage and Deletion

Important: All uploaded photos and generated videos are automatically deleted from our servers after 30 days. This policy applies to all users regardless of subscription status.

You are responsible for:

• Downloading your generated content before the 30-day period expires
• Maintaining your own backups of important photos and videos
• Understanding that deleted content cannot be recovered

4. User Accounts

To access certain features of our Service, you may be required to create an account. When creating an account, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information to keep it accurate
• Accept all risks of unauthorized access to your account
• Be at least 18 years old or the age of legal consent in your jurisdiction

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

5. Acceptable Use and Content Guidelines

You agree not to use the Service to:

We reserve the right to remove any content that violates these guidelines and terminate accounts of repeat offenders.

Your Content

You retain ownership of any photos you upload to the Service. By uploading content, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

• Process and transform your photos into animated videos
• Store your content temporarily (up to 30 days)
• Display your content back to you within the Service

This license terminates when your content is deleted from our servers. We do not claim ownership of your photos or generated videos.

7. Credits and Payment Terms

Our Service operates on a credit-based system. Credits are used to generate animations:

• Credits are purchased through our secure payment provider (Creem)
• Credit prices and packages are displayed at the time of purchase
• Credits do not expire unless your account is terminated
• Credits are non-transferable between accounts
• Unused credits are not refundable except as required by law

Subscription Plans

If you subscribe to a plan:

• Subscriptions renew automatically unless cancelled
• You can cancel at any time through your account settings
• Unused monthly credits may or may not roll over depending on your plan
• Refunds are handled according to our Refund Policy

8. AI-Generated Content

Our Service uses artificial intelligence to generate animated videos from your photos. You acknowledge and agree that:

• AI-generated content may not always meet your expectations
• Results may vary based on the quality and content of uploaded photos
• We do not guarantee specific outcomes or quality levels
• You are responsible for how you use and share AI-generated content
• AI-generated content should not be used to deceive or mislead others

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL STILLGLOW, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless Stillglow and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Content you upload to the Service
• Your violation of any third-party rights

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

• Your right to use the Service will immediately cease
• Your uploaded content will be deleted
• Unused credits will be forfeited (except where prohibited by law)
• You may request a copy of your data before termination

12. Privacy Policy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information and uploaded content.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in Delaware.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
